We do not warrant that our systems will be completely free from unauthorized access, hacking, or other breaches. You may register or log in to your account using a third-party service such as Google or Facebook. By doing so, you authorize Rixoc Ebike to pre-fill your registration details and/or use your third-party credentials for login. If you connect your account to a third-party service, you agree to comply with that third party’s terms and policies.

Certain Services may integrate Google Maps API or related features. By using these, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service.

Section 3 – Prohibited Uses

We expect all users to respect the Rixoc Community Standards. The website and its Services are provided for your personal, non-commercial use only. Is illegal, obscene, defamatory, threatening, harassing, abusive, or hateful, or that promotes violence;

Contains or distributes viruses, worms, Trojan horses, or other harmful code;

Infringes or violates any third-party intellectual property rights, privacy, or publicity rights, including copyrights, trademarks, or trade secrets;

Is fraudulent, deceptive, or misleading in any way (including phishing or impersonation).

Attempting to disrupt, degrade, impair, or compromise the integrity or security of the Services or any related networks, servers, or user accounts (including hacking, denial-of-service attacks, probing, or vulnerability testing);
Attempting to avoid payment of fees or charges associated with the Services;
Engaging in any activity that may harm minors;
Using automated systems (including robots, spiders, scrapers, or offline readers) to access the Services in a way that sends more requests than a human could reasonably produce using a normal browser;
Taking actions that, in Rixoc Ebike’s sole discretion, impose an unreasonable or disproportionately large load on our infrastructure;

4. you are responsible for all royalties, fees, or other amounts owed as a result of the content you post through the Services.

We reserve the right to correct or update the Website with respect to products at any time without prior notice (including after you have submitted an order). If you do not wish to continue your purchase after pricing or other product information has been corrected, please contact us right away.

Product availability on the Website is not guaranteed as it may be low in stock or otherwise unavailable due to reasons beyond our control. If any selected product is not available at the time your order processes, we will notify you of this.

We reserve the right to change any component or part of our eBikes, or to change manufacturers of component parts with equivalent or improved performance without notice to you. Such changes, as well as any modification to the manufacture of our bikes, shall not constitute grounds for returning the product.

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel the quantity of purchases per person, per household, or per order. These limits may include orders placed using the same customer account, the same credit card, and/or the same billing address and/or shipping address. If we change or cancel an order, we may attempt to contact you using the email address and/or billing address/phone number you provided when placing the order. We reserve the right to limit or prohibit orders placed by resellers, resellers, or distributors in our sole discretion.

You agree to provide up-to-date, complete, and accurate purchase and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address, credit card number, and expiration date, so that we can complete your transactions and contact you if necessary.

All prices listed on the Rixoc website are subject to change without prior notice. The price charged for a product will be the price in effect at the time your order is placed. Any price changes—whether increases or decreases—will apply only to orders placed after such changes take effect and will not affect existing orders.

Posted prices do not include applicable taxes, or handling fees. All such charges will be added to your order total and displayed during checkout. Additional surcharges may apply for oversized or heavy items. While we make every effort to ensure accurate pricing, typographical or other errors may occur. We reserve the right to correct such errors and to cancel any orders resulting from them.

Payment terms are at our sole discretion. Unless otherwise agreed in writing, full payment must be received before we accept your order. You represent and warrant that:

(i) the credit or debit card or other payment information you provide is true, complete, and accurate;

(ii) you are authorized to use such payment method;

(iii) all charges incurred will be honored by your financial institution;

In no event shall Rixoc, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any part of the Service or any products procured through the Service.

Bike Performance Disclaimer：The bike's listed range and top speed are estimates (not guarantees) of expected performance. Performance will vary with rider weight, cargo weight, rider /cargo shape (both contribute to drag), terrain, tire pressure, brake adjustment, throttle vs PAS usage, pedal power, battery charge level, ambient temperature, and wind conditions. Under certain conditions it is possible to get ranges and top speeds that are different from the listed estimates.

This limitation applies to any claim related in any way to your use of the Service or any product, including, but not limited to, errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of the Service or any Content (or products) posted, transmitted, or otherwise made available through the Service, even if we have been advised of the possibility of such damages.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, Rixoc’s liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Rixoc and its parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or relating to:

Your violation of these Terms of Service or any documents incorporated by reference;

Your violation of any applicable law; or

Your infringement of the rights of any third party.

This indemnification obligation survives the termination or expiration of your use of the Service.

Section 15 - Liability Disclaimer: Products

Riding any bicycle involves inherent risks and dangers that cannot be completely predicted or avoided. Such risks may result in serious accidents, injury, or death. It is the sole responsibility of the rider to become properly educated, trained, and prepared to ride safely.

Upon taking possession of the bike, Rixoc strongly recommends that all customers have a certified and reputable bicycle mechanic perform a full inspection of every component on the bicycle to ensure it is safe for operation. Rixoc makes no claims or guarantees that the brakes, battery, frame, motor, motor controller, display, electrical cables, cable housings, fasteners, grips, fork, stem, shifters, headset, seat post, seat post clamp, handlebar stem clamp, saddle, wheel hubs, handlebars, spokes, rims, tires, tubes, derailleur, freewheel, cassette, throttle, kickstand, lights, reflectors, hardware, bottom bracket, or any other part or accessory will be properly secured or adjusted upon delivery.

Before every ride, you should fully inspect your bicycle to ensure that all components are properly secured and adjusted.

Under no circumstances shall Rixoc be responsible for any damage resulting from damaged, defective, or improperly secured parts. This includes, but is not limited to, damage to personal property, personal injury, or death.

Section 16 - Order Acceptance and Cancellation

Orders are initiated when you submit an order through the Rixoc website. By placing an order, you are making an offer to purchase, under these Terms, all products listed in your order. All orders must be accepted by Rixoc; until such acceptance, we are not obligated to sell the products to you. Rixoc may, at its sole discretion, refuse to accept any order for any reason.

To complete your order, you may be required to provide certain information relevant to your transaction, including, without limitation, payment information (such as credit or debit card number and expiration date), billing address, and shipping details. By providing this information, you authorize Rixoc to share it with third parties solely for the purpose of processing and fulfilling your order.

Any fees or charges incurred up to the date of termination shall remain your responsibility. Upon termination, you may also be denied access to all or part of our services for the remainder of the term.

These Terms of Service, and any separate agreements through which we provide you services, shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.
